This regulatory framework can be difficult to navigate as each business transaction and the overall operations of the FQHC must comply with the requirements of the Health Resources and Services Administration ("HRSA"), the Centers for Medicare Services ("CMS"), section 501(c)3 of the Internal Revenue Code, the Federal Anti-Kickback and Stark laws, the California Anti-Kickback and self-referral laws, the California Department of Health Care Services ("DHCS"), the California Department of Public Health licensure requirements, as well as local county regulations.
